==Purpose==
Title IX states, ''“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance…”''

The intent and purpose of Title IX is morally prodigious. Title IX has looked to accomplish modification to the unjust educational opportunities of its era. Title IX applies to all aspects of educational equality, however; Title IX’s center point became athletics supported by educational institutions.

Title IX requires equal distribution of equipment, supplies, funds, game time, practice time, compensation, locker rooms, facilities, and medical services.

In 1979 The Department of Health, Education, and Welfare interpreted Title IX and articulated a three prong test to evaluate an educational institution’s compliance.

* The first prong (proportionality test) states, “all such assistance should be available on a substantially proportional basis to the number of male and female participants in the institution’s athletic program.”

Interpreted, the test is satisfied when men and women athletic participation is proportional to their respective undergraduate enrollment. For example, if 38% of the students are female, then 38% of the athletic participation must be female.

This prong has created equality by cutting men’s programs rather than growing women's programs. Statistically, colleges have more women than men. However, studies have shown that men are two times more likely to participate in sports. The proportionality test requires an equal balance in all situations, even though all situations will never have a perfect equilibrium of participation. In order to meet these standards, universities have cut men’s sports programs and sometimes force women into the female programs.

These Title IX solutions, as played out through recent history, are not yielding ideal benefits. This part of Title IX sustained widespread limitations on athletic and academic opportunities for men. No man nor women wishing to form a sports team should be denied the right to assemble, form a team, and compete. Pressing to meet Title IX's proportionality test standards have failed students in their real world quests on campuses.

Eliminate the proportionality test and create equal opportunity for men’s and women’s programs to grow freely. The elimination of the proportionality test will enable continued support for women athletics and protection from discrimination while ending the harm to male programs. University settings should be places where free growth occurs, even among sports settings.

==Proposal==
Reinterpret Title IX’s three-prong test with a dismantling of the first prong, the proportionality test. Make participation in athletics unbound by any proportion linked to enrollment. Rather, insists institutions provide adequate opportunities to any male or female programs that exists or wants to be created.

Reemphasize the older resolution in Title IX that states, “The athletic interest and abilities of male and female students must be equally and effectively accommodated.”

===Results to be expected===

The initial results of this change to Title IX will be the recreation of many lost programs due to Title IX’s proportionality test. Also, this change will let universities allow athletic departments to prosper and grow. Growth will, in turn, lead to more competitive Universities with wider campus diversity. This small change in Title IX will immediately improve male enrollment in higher education. And this change can slowly increasing female enrollment.
